Terms of Service

1. Agreement

These Terms of Service ("Terms") form a legal agreement between you and GeneChecklist ("we", "us", "the Service"). By creating an account or using genechecklist.com, you agree to these Terms. If you don't agree, don't use the Service.

You must be at least 13 years old (16 in the EU/UK) to use the Service.

2. Account

• You are responsible for the security of your account credentials.
• You must provide a working email address; confirmation may be required.
• One account per person. Sharing accounts is not allowed.
• You agree to notify us immediately if you suspect unauthorised access.

3. Acceptable use

You agree not to:

• Use the Service for any illegal purpose.
• Upload, share, or generate content that is harmful, hateful, harassing, defamatory, infringing, sexually explicit involving minors, or otherwise unlawful.
• Reverse-engineer, scrape, or attempt to bypass our rate limits, paywalls, or security measures.
• Use automated tools to create accounts, generate AI requests in bulk, or stress the Service.
• Impersonate any person or entity, including us.
• Resell or re-distribute the Service or its content without permission.

4. Your content

You retain full ownership of the checklists, lists, descriptions, logos, and other content you create or upload ("Your Content").

You grant us a limited, non-exclusive licence to host, store, process, display, and back up Your Content solely to operate the Service. When you make a checklist publicly shareable, you grant us a licence to display that content to anyone with the share link.

You are responsible for ensuring Your Content does not infringe any third-party rights.

5. Our content

The pre-built checklist templates, AI-generated suggestions, software, design, and brand are owned by us. You may use the templates for personal or business purposes through the Service. You may not republish, copy, or resell our templates as a standalone product.

6. Free and Pro plans

6.1 Free plan

The Free plan is offered with the limits described on our Pricing page: 3 saved lists, 5 AI suggestions per month, 1 active public share link, plus unlimited PDF downloads. Free plan pages may display advertising.

6.2 Pro plan

Pro plans are monthly subscriptions priced at $4 USD per month (or such other price displayed on the Pricing page at the time of purchase). Pro removes all limits, removes advertising, and unlocks CSV / Excel / Word / Markdown / Google Docs exports plus branded PDFs.

• Billing is handled by Stripe; you authorise recurring charges to your saved payment method.
• The first 7 days are free as a trial. We will not charge you during the trial. You can cancel any time during the trial with no charge.
• If you do not cancel, the subscription auto-renews monthly until cancelled.
• Prices may change with at least 30 days' notice.
• Failed payments may suspend Pro access; we'll retry and email you before downgrading the account.

6.3 Cancellation

You can cancel any time from your account settings. After cancellation you keep Pro access until the end of the current billing period. See our Refund Policy.

7. AI features

AI suggestions are generated by a third-party large language model (currently Anthropic Claude). AI output can contain errors, omissions, or out-of-date information. You are responsible for verifying any AI suggestion before relying on it, especially for safety-critical, medical, legal, or financial contexts. See our Disclaimer.

8. Service availability

We aim for high uptime but the Service is provided "as is". We may modify, suspend, or discontinue any part of the Service with or without notice. We will give reasonable notice (at least 30 days) before discontinuing the Service entirely.

9. Disclaimers and limitation of liability

To the maximum extent permitted by law, the Service is provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Our aggregate liability for any claim arising from or relating to the Service shall not exceed the greater of (a) the total amount you paid us in the 12 months before the claim, or (b) $50 USD.

We are not liable for indirect, incidental, consequential, special, or punitive damages, lost profits, or lost data, even if advised of the possibility.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded under applicable law (e.g. for gross negligence or fraud).

10. Indemnification

You agree to indemnify and hold us harmless from claims arising out of (a) your breach of these Terms, (b) Your Content, or (c) your misuse of the Service.

11. Termination

You can delete your account any time. We may suspend or terminate your account for breach of these Terms, prolonged inactivity, or legal requirement. Sections 4, 5, 9, 10, 12, 13 survive termination.

12. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Disputes shall be resolved in the state or federal courts located in Delaware, except where applicable consumer protection laws (including for EU residents) provide otherwise.

13. Changes

We may update these Terms. Material changes will be announced at least 30 days in advance by email and via a notice on the site. Continued use after the effective date constitutes acceptance.
